Are you eager to know how to stop garnishment and take back your pay check? Are your wages garnished that you can’t pay your bills? Act quickly! The longer you wait the harder it is to stop garnishment.
Step one: Contact the person who is garnishing your wages, negotiate with them a payment plan and put it in writing then you need to file it with the court clerk. It may be tough at first but there are a few things you have in your favour.
Judges are going to be especially lenient because of the fact that the economy is down.
File a Slow-Pay Motion in court and have your payments set to a fairly small amount. If you follow this route, your payments will probably be significantly smaller than the agreed amount with the original debtor. But since none of you probably wants to go to court, you can use this to get them to compromise with you.
The person you owe just wants to be paid. You can mention to your debtor that you can’t pay your bills like this and if the garnishment continues, you’ll have no choice but to quit your job and find income elsewhere. This would make it longer before the creditor got the money. (You can just threaten to quit but not actually do it.) Take note that this is just a LAST RESORT! Don’t ever threaten the creditor if there is ANY other way out of it!
Since I am not an attorney, I am just relaying what has worked for me and a number of people that I am associated with. It’s always advisable, if possible, that you seek expert legal advice! These tactics have been successfully used on my part but I can NOT vouch for the legality of them. Always use with caution! I don’t recommend using this tactic if a government agency is the one who is garnishing you. Please don’t threaten the government!
I have been there. Garnishment is not fun. You have to do something when the garnishment is taking so much of your income that you already can’t pay your rent. As much as you can, work it out with the person you owe but if you can’t, take it to the courts! You shouldn’t let these people bully you out of your home!
